You're reading: AeroSvit’s head can be convicted for violating labor laws

The territorial state labor inspectorate in Kyiv region, after checking complaints from the trade unions of AeroSvit Airline (Kyiv), in 2012 held the head of the airline administratively liable for the non-observation of labor laws six times, the press service of the Prosecutor General's Office in Kyiv region has reported.

The press service said that at present the issue of convicting him of a criminal offence is being decided.

“The Prosecutor General’s Office has attracted specialists of the territorial state labor inspectorate in Kyiv region, the state financial inspectorate in Kyiv region and the department of the Pension Fund in Boryspil and Boryspil district to check facts of mass dismissals of employees and non-payment of wages. In the near term, the legal assessment of actions of officials who are guilty in violation of labor rights of the airline’s employees will be presented,” a press release of the Prosecutor General’s Office said.

The release reads that the Prosecutor General’s Office intends not to allow the violation of the rights of AeroSvit’s employees. It was noted that the investigation department of the police at the Boryspil airport is conducting a pretrial investigation into facts of non-payment of wages to the airline’s employees and violation of the agreement and labor laws.

“The Prosecutor General’s Office in the region permanently monitors the pretrial investigation into the said criminal proceedings,” reads the press release.

On December 7, 2012, the Prosecutor General’s Office sent a recommendation to the airline’s director general to remove the non-observation of the requirements of the law on labor payment – the payment of wages for November 2012 in the sum of UAH 11.03 million, which currently has been paid in full.

In addition, on January 23, 2013 the Prosecutor General’s Office recommended to remove the non-observation of the requirements of the law on the unitary obligatory social insurance tax collection and the law on labor payment and pay the wage arrears of UAH 24.3 million and pay the unitary social tax of UAH 8.7 million.

The wage arrears of UAH 3.22 million and the debt on the unitary social tax of UAH 769,000 have been paid at present.

AeroSvit was created in 1994. It is based at Boryspil airport in Kyiv. Its fleet consisted of 28 Boeing aircraft, including 20 medium-range Boeing 737s and eight long-haul Boeing 767s. In addition to that, it operated Airbus 320, Airbus 321, Embraer 145, Embraer 190, and ATR-72 aircraft.
