Ukraine's Higher Administrative Court has dismissed an appeal by a candidate of the Batkivschyna United Opposition in single-member constituency No. 197 (Kaniv, Cherkasy region), Leonid Datsenko, against a Central Election Commission decision dated November 5 about the impossibility to establish the election results in five constituencies.

A panel of judges lead by Judge Mykhailo Zaitsev announced this ruling, the press service of the Batkivschyna All-Ukrainian Union reported.

Kyiv Administrative Court of Appeal earlier dismissed Datsenko’s appeal against this decision by the Central Election Commission. The candidate also asked the court to oblige the commission to establish the election results in constituency No. 197 and recognize him as a winner in this constituency.

As reported, the Central Election Commission (CEC) received the vote-count protocols from district election commission No. 197 (Kaniv, Cherkasy region).

According to the protocol, self-nominee Bohdan Hubsky won in this single-member constituency with 29,084 votes (35.65%), whereas his principal rival – a representative of the Batkivschyna United Opposition, Leonid Datsenko, took 25,961 votes (31.82%).

However, the results of a public vote count in this constituency show that Datsenko is more than 4,000 votes ahead of Hubsky.

The Central Election Commission adopted a resolution on November 5 recognizing the impossibility of announcing parliament election results in five single-seat constituencies – Nos. 94, 132, 194, 197 and 223. In addition, the commission recognized the need to hold repeat elections in these constituencies and asked the parliament to take a decision on the holding of repeat elections there.
