You're reading: The Court turns down Tiahnybok’s lawsuit on illegal creation of Communist Party faction

The Higher Administrative Court of Ukraine has rejected a lawsuit of the leader of Svoboda faction in the parliament Oleh Tiahnybok to declare illegal the actions of the parliament in announcing the creation of the Communist Party faction.

“The court decided to reject Verkhovna Rada MP of the seventh convocation Oleh Tiahnybok in satisfying a lawsuit against the Verkhovna Rada on declaring its actions illegal,” says the decision, which was announced by Judge Inna Maslo.

She said that decree of the Higher Administrative Court of Ukraine is final and cannot be reconsidered at an appeals court.

In his lawsuit, Tiahnybok asked that the actions of the Verkhovna Rada in announcing the Communist Party as a faction be declared illegal, as it violates Article 58 of the Ukrainian law “On regulations of Verkhovna Rada”, according to which deputy factions are formed depending on the number of deputies elected under party lists and majority constituencies.

As reported, 32 candidates from the Communist Party became MPs under its party list, but none in majority constituencies.

In turn, during the court sitting, the representative of Verkhovna Rada said that this suit had been presented to the wrong agency, since according to procedure, MPs submit applications to enter the faction to the Verkhovna Rada staff, and the chairman at the sitting must report this according to the demands of the regulations.

“But the Verkhovna Rada has made no such announcements,” he said.

After the announcement of the court decision, the representative of Tiahnybok said that after learning of the text of the decision, Svoboda could address to the Constitutional Court of Ukraine demanding that it interpret part 1 of the Article 58 of the law “On Verkhovna Rada regulations.”
