MOSCOW - The Russian intellectual rights court on July 30 scheduled the main hearing of a claim of OJSC Lipetsk confectionary factory (a subsidiary of Ukraine's Roshen corporation which belongs to Ukrainian President Petro Poroshenko) against OJSC Novosibirsk refrigerating plant on the early termination of the legal protection of the Vanilla sky trademark (No. 267713) regarding NICE 30 class goods.

According to the materials of the case, the claimant is pursuing the case as it did not apply the trademark to NICE 30 class goods (sweets, chocolate, coffee, sugar and confectionary products).

The trademark was registered to the defender in April 2004 for the period until April 2023 regarding NICE 29 class goods (mainly foodstuffs of animal origin as well as vegetables and other horticultural comestible products which are prepared for consumption or conservation) and NICE 30 class goods (mainly foodstuffs of plant origin prepared for consumption or conservation as well as auxiliaries intended for the improvement of the flavor of food).

Roshen Corporation, one of the largest producers of confectionery goods in Ukraine, includes Kyiv, Kremenchuk (Poltava Oblast) and Mariupol confectionery factories, two production sites in Vinnytsia Oblast, Bershadmoloko milk and butter plant (Vinnytsia Oblast), two production facilities in Lipetsk region (Russia), and Klaipeda confectionery factory (Lithuania).
