You're reading: Government proposes state executive service be released from court fees

The Cabinet of Ministers on January 30, 2013 approved a draft law, which foresees the release of state executive authorities from paying court fees, and will submit it to the Verkhovna Rada, the press service of the Justice Ministry has said.

The bill was developed by the Justice Ministry to reduce the expenses of the national budget.

Justice Minister Oleksandr Lavrynovych said that the government bill proposes amendments to Article 5 of the law on court fees, due to which state executive authorities will be exempted from paying fees on the issues related to the powers of these bodies.

This legislative initiative is explained by the fact that more than 80% of complaints and lawsuits filed to court against state executors are submitted by debtors. Most frequently debtors contest rulings on the recovery of executive fees. In fact, as the practice shows, almost every judgment on executive fee collection is contested by debtors.
