You're reading: Partial mobilization does not affect private business in general, says lawyer

A partial mobilization will not affect private business in general and the operation of enterprises that are not included in the mobilization plan and do not send charity payments, while lawmakers could also avoid mobilization, a lawyer from Asters law firm Volha Sheiko has said.

The expert told Interfax-Ukraine that in general companies would
suffer from a partial mobilization only if employees of such companies
are mobilized. She said that partial mobilization would mainly affect
medical institutions.

Sheiko drew attention to the fact that the law on mobilization
preparation and mobilization foresees their financing using funds from
the national budget, local budgets, funds of companies, institutions and
organizations. Measures and works on the mobilization preparation of a
state importance are financed from the national budget, while Measures
and works on the mobilization preparation of a local importance are
financed from local budgets.

According to the law, measures and work on the mobilization
preparation carried out under an initiative of enterprises, institutions
and organizations themselves under the mobilization plans are financed
using funds of enterprises, institutions and organizations.

“The mobilization preparation and/or mobilization could be financed
additionally thanks to charity payments from individuals and companies
under a procedure set by the government. If your enterprise is not
included in the mobilization plan and does not send charity payments,
your business could continue developing and mobilization will not touch
it,” the lawyer said.

Sheiko said that taking into account the order of the president on
the partial mobilization, citizens liable for call-up and reservists
could be mobilized. According to the law on call-up, citizens liable for
call-up are persons in reserve for recruitment for the army and other
military units for a special period and for the fulfillment of works to
provide for defense of the state, and reservists are persons who
voluntarily serve in the war reserve.

“According to the order of the president, mainly reserve officers and
sergeants of all military professions up to 45 years, soldiers in
reserve of all military professions up to 40 years and general officers
of all military professions up to 60 years will be called up – that is
almost all persons. However, the top-priority will be given to officers
and professionals, and these are capable officers (Afghan war
participants, former special task force officers, representatives of SBU
divisions, special units), and experienced people who took part in real
war,”

According to the rules on a procedure for assigning qualification
categories to military men, doctors and pharmaceutists, some categories
of citizens liable for call-up (mainly under their consent) could be
mobilized.

Sheiko said that only military men taken by state power agencies for
the period of mobilization and military men declared temporary incapable
for military service due to their health state for the period of up to
six months, men who raise five and more children up to 16 years old,
women who have children up to 16 years old and citizens who take care of
any person if no one else could provide for taking care of him or her
and lawmakers could avoid mobilization.
