The district administrative court of Kyiv has postponed the hearing of a claim of Atlasjet Ukraine airline (Lviv) which demands to deprive Ukraine International Airlines (UIA, Kyiv) of some assignments to perform international flights for Oct. 7, a lawyer of Marchenko Danevych law firm Andriy Huk has told Interfax-Ukraine.

He also said that the court postponed the hearing of a claim of UIA against the Infrastructure Ministry of Ukraine, in which UIA demands to return the right to perform 16 flights a week on the Kyiv-Istanbul route and seven flights a week on the Odesa-Tel-Aviv route for Oct. 3.

As reported, Atlasjet Ukraine through the court required to deprive UIA of all permits for the fulfillment of international scheduled flights as on Sept. 20, 2013 the licensing commission at the Ministry of Infrastructure of Ukraine provided UIA with permits to the routes of Kyiv-Istanbul and Odesa-Tel Aviv, to which Atlasjet Ukraine also pretends, but, according to the Lviv airlines, the commission’s decision is unlawful and should be abolished, as well as the rights of UIA to operate the routes, permits for which were issued on the basis of the commission’s decision.

Atlasjet Ukraine links this to the fact that Ukrainian law does not allow the commission to give the right to flights to airlines by the commission without their written applications, adding that UIA did not submit applications on the re-registration of the assignments to the above-mentioned routes.

The claimant said that the commission for the formation and realization of state policy in the exploitation of air routes in protocol No. 15 of July 3, 2014 permitted Atlasjet Ukraine to exploit the Kyiv-Istanbul and Odesa-Tel-Aviv routes, although case No. 826/11891/14 opened under a claim of UIA against the Infrastructure Ministry of Ukraine on the cancellation of protocol No. 15 of the commission is in the District Administrative Court of Kyiv.

According to the claimant, UIA explains violation of its rights by availability of own rights to exploit the routes.
