Ukraine in 2013 was conducting quite a vigorous legislative activity: many important regulations, aimed at bringing the Ukrainian legislation in line with the best international standards and stimulating the economy, were adopted. At the same time, lawyers note that in fact many legislative initiatives had no implementation mechanisms in the regulatory framework or even more complicated conducting business. 

One of the key and most important changes in the legislation in the past
year, which influenced businesses and Ukraine’s economy, is a new Criminal
Procedure Code. The main achievement of the new Criminal Procedure Code is the
reduction in a number of cases when a person can be detained.

“If previously accused persons were taken into custody during a preliminary
investigation almost automatically, now the judiciary resorts to alternative
measures. According to the new Criminal Procedure Code, the system of preventive
measures is also based on the decriminalization of many economic crimes, which
allows to replace arrest with indemnification,” senior lawyer at L.A.Group law
firm Viktoriya Chanischi said.

According to the lawyer, businesses in almost all fields in the country felt
the impact of the new Criminal Procedure Code.

“There are no enterprises that do not undergo tax checks and, as a
consequence, risk to appear in the field of criminal proceedings due to tax
evasion.”
