Chairman of the Central Election Commission (CEC) of Ukraine Volodymyr Shapoval has said that the clause about the possibility of simultaneously running to the parliament on a party list as well as individually in a single mandate constituency should be removed from the election law.
"It would be nice if all the political forces could agree to remove the provision on the possibility of running simultaneous in a single-mandate constituency and on the party lists from the existing law," Shapoval said in an interview published in the Dzerkalo Tyzhnia. Ukraine newspaper on Saturday.
"There is every reason to doubt constitutionality of this clause. In 1998, the Constitutional Court clearly stated its legal position on this issue, denying the possibility of being simultaneous nominated in a single-mandate constituency and on party lists. How could they have ignored this ban while preparing a new law on parliamentary elections?" he stressed.
"When asked to suggest the legal consequences of this discrepancy, the CEC head said, "If after the elections the Constitutional Court recognizes this provision as unconstitutional, the legitimacy of the election result would be put in question."
