The Pechersky District Court in Kyiv has issued a ruling to close a criminal case against former First Deputy Justice Minister Yevhen Korniychuk in connection with the use of the amnesty law.
An Interfax-Ukraine reporter said that the court issued such a ruling on Friday after considering a petition by Korniychuk’s lawyers.
The court ruling refers to Clause 4, Article 6 of the Criminal Procedure Code outlining the circumstances that exclude criminal proceedings.
The Prosecutor General’s Office detained Korniychuk on Dec. 22, 2010.
On Dec. 30, the Pechersky District Court of Kyiv ordered that Korniychuk be taken into custody for two months as a pre-trial restriction, and then he was transferred to the Kyiv pre-trial detention center.
On Feb. 15, the investigator changed the pre-trial restrictions on Korniychuk from arrest to a written undertaking not to leave Kyiv.
Korniychuk was accused of having committed a crime under Part 3 of Article 365 of the Criminal Code (abuse of power or office) and Part 2 of Article 366 (forgery by an official).
These charges envisaged punishment in the form of imprisonment for seven to ten years (under Part 3 of Article 365) and two to five years (under Part 2 of Article 366).
Some media reported that on Dec. 22 Korniychuk had provided testimony in a case related to the provision of services by the Magisters law firm (formerly known as Magister & Partners) to Naftogaz Ukrainy.
Korniychuk is charged that he, while serving as Ukraine’s first deputy justice minister, signed a letter permitting the holding of a tender on the provision of legal services to Naftogaz from a single law firm.
As the charges have been changed, Korniychuk may be punished by two years of corrective work, five years in prison, or two to five years in prison (under Part 1 of Article 365) and a fine equal to 50 non-taxable minimum incomes, or three years in prison (under Part 1 of Article 366).
