Our Ukraine Party: Yanukovych violated law on Holodomor of 1932-1933

The Our Ukraine Party believes that Ukrainian President Viktor Yanukovych's statement that it would be unfair to recognize the Holodomor of the 1930s as an act of genocide against the Ukrainian people violates the country's law on the Holodomor. "By his statement, Yanukovych directly violated the norms of the Ukrainian law of November 28, 2006 on the Holodomor of 1932-1933 in Ukraine, the first article of which clearly states: 'The Holodomor of 1932-1933 in Ukraine is genocide against the Ukrainian people.' And Article 2 says: 'Public denial of the Holodomor of 1932-1933 in Ukraine is considered the desecration of the memory of millions of Holodomor victims, the humiliation of the dignity of the Ukrainian people and is illegal," the party's press service said on Tuesday.

The document also says that "Yanukovych has ignored a ruling of January 13, 2010 by Kyiv's Court of Appeal, which recognized the leaders of the totalitarian Bolshevik regime as those guilty of 'genocide against the Ukrainian national group in 1932-33 through the artificial creation of living conditions intended for its partial physical destruction.'"

The press service said that the president had "actually opposed himself to the position of parliaments in Estonia, Australia, Canada, Hungary, Lithuania, Georgia, Poland, Peru, Paraguay, Ecuador, Colombia, Mexico and Latvia, which officially recognized the Holodomor as an act of genocide against the Ukrainian people." The head of state also contradicts the position of the European Parliament, which recognized the Holodomor as a crime against the Ukrainian people, the press service said.

As reported, Yanukovych said at the PACE session in Strasbourg on April 27 that the famine of 1932-1933 could not be regarded as an act of genocide against the Ukrainian people.

"The Holodomor was in Ukraine, Russia, Belarus and Kazakhstan. It was the result of Stalin's totalitarian regime. But it would be wrong and unfair to recognize the Holodomor as an act of genocide against one nation," he said.

On November 28, 2006 the Verkhovna Rada of Ukraine adopted a presidential law on the Holodomor with amendments proposed by Parliament Speaker Oleksandr Moroz. The parliament recognized the Holodomor of 1932-1933 as genocide against the Ukrainian people.

Our Ukraine and Yushchenko violated Ukraine's constitution and laws so many times it is little wonder that people ignore the abuses that are now being perpetrated, Our Ukraine to a large extent is responsible for the current situation in Ukraine.

Lets not forget it was Yushhenko that created the environment for this to happen. It was Yushchenko who wanted to strengthen the presidential system. It was Yushchenko who betrayed Ukraine and all those who supported his election in 2004.

If Yushchenko and Our Ukraine had supported change in 2006

things would have been much different. The first mistake was refusing to form a "orange" coalition government days after winning the 2006 Parliamentary elections.

Instead of reforming Ukraine and strengthening democracy Yushchenko

undermined it, destroying any hope for change and the adoption of democratic values.

If it was not for Yushchenko and Our Ukraine refusal to support the formation of an orange coalition and embrace democratic reform back in 2006 Ukraine would not be in this situation.

The only hope for any real change is for Ukraine to adopt a full

parliamentary model of governance and to reform the parliament to allow for local direct electoral mandates. The introduction of preferential voting (STV Proportional representation) and the removal of presidential authority. It is only by empowering Ukraine and ensuring that its system of government is truly representative that democracy can take hold and flourish.

But the SBU under Yushenko, when he ordered there investigations into this (and as reported by the KP at the time last year) also stated it was not genocide against Ukrainian people, but was a crime.

So the SBU also broke the laws last year when they carried out this investigation and delivered their results?

This was under Yushenko not Yanuk.

How can Ukraine have had a law exisiting calling it genocide if the SBU were instructed to investigate it last year and stated it was not genocide?

Again, back in January this year:

Now to my understanding, the named people include 1 Georgian. 1 Ukrainian, 1 Polish chap and 2 Russians.

There is no mention of the word &quot;genocide&quot; in this either, again whilst Yush was in power.

Very, very strange.
