You're reading: British owner of Globus mall regains physical control over mall

London & Regional Properties (L&R Properties, London), which owns a 100 percent stake in Globus mall located in downtown Kyiv via three Ukrainian companies, on Wednesday regained physical control over the mall, Senior partner of the KM Partners law firm (Kyiv) Oleksandr Minin, who represents the interests of London&Regional Properties, has said.

"Today, from 1100 to 1300 physical control over the Globus mall was regained by its owner - London & Regional Properties, director of L&R in Ukraine Sviatoslav Ilchenko," Minin said.

He also said that the court of appeals on October 15, 2013 canceled a ruling of Solomiansky District Court of September 16, 2013, under which Olena Morris was reinstated to the post of director general of the Globus company.

“Today, when we arrived to the Globus mall, almost no one from the team of Morris was present, apart from the former chief security officer. The keys were given to us. At present, the system is being reprogrammed for the full restoration of control over all systems,” he said.

Minin also said that the owner of the Globus mall – L&R Properties – and the top managers of LR Globus LLC, which leases premises of the mall, are monitoring the mall’s issue with Kyivenergo.

“The issue is under control and it will be settled. I could say that the mall will not be disconnected from electricity,” he said.

Earlier on Wednesday Kyiv City Administration reported that Kyivenergo plans at 2230 on October 16, 2013 to disconnect the Globus mall from electricity due to its having a debt of over UAH 900,000.

As reported, London&Regional Properties, which owns the Globus mall via three companies in Ukraine Delight LLC, Delight Plus LLC and Delight City LLC, declared that the mall was illegally seized and the company plans to protect its rights to the assets, including in the Court of Strasburg.

“Our mall was seized illegally… Globus was seized by Mrs. Morris. Today, we gathered here to address officials in the government who can help us to return the assets that were illegally seized to our ownership,” London&Regional Director Leonard Sebastian said at a press conference in Kyiv in late September.

The grounds for the seizure was the ruling of the Solomiansky District Court of September 16, 2013, under which Morris was reinstated director of LR Globus LLC. Then Minin said that Morris has never run this post.

Kyiv prosecutors have brought an action to meet a claim filed by Globus shopping mall’s investors against an attempt to illegally seize the mall’s administrative premises.

The Globus mall was commissioned in 2001. Its gross area is 35,400 square meters and retail area – 18,580 square meters. 100 percent of the mall belongs to London&Regional Properties.
