You're reading: Expansion of presidential powers on creation and liquidation of courts ruled constitutional

The Constitutional Court of Ukraine has ruled that the expansion of the Ukrainian president's powers on the creation and disbanding of courts of general jurisdiction is constitutional.

An Interfax-Ukraine reporter said that the court had issued such a ruling on Thursday.

The court recognized as constitutional a provision from the law of July 7, 2010 on the judicial system and the status of judges, under which courts of general jurisdiction are formed and disbanded by the Ukrainian president under a motion from the Justice Ministry and on the basis of proposals from the head of a respective supreme court.

The court also recognized as constitutional a provision of the law, under which judges elected for an indefinite term are transferred from one court to another, of the same level and specialization, by the Ukrainian president at the written request of judges.

MPs who submitted a respective motion to the Constitutional Court believed that the constitutional powers of the Ukrainian president had been extended under these provisions.

The court also recognized as constitutional a provision of the law on the judicial system and the status of judges, under which the State Court Administration was empowered to determine the number of judges in the courts.
