Jailhouse Watch: Many former top officials remain in jail for months

Editor’s Note: Experts say excessive pre-trial imprisonment is a major human-rights problem in Ukraine, where suspects can be jailed for up to 18 months before trial. The practice violates democratic principles that call for speedy, fair and public trials as well as the presumption of innocence until proven guilty. More than 40,000 people in Ukraine are imprisoned without trial. The Kyiv Post will keep track of this issue through this new feature called “Jailhouse Watch.”

I am interested to know who these experts are that consider our legal procedures to be a human rights issue. Are they Ukrainians? Are they resident here, or Diaspora? If they don’t like our system they should, through the proper channels endeavour to change it. Our system works well and is much better than say in America where you can be placed in jail without even being accused of a crime for an indefinite period for no other reason than being of the wrong nationality. A phrase I heard a long time ago seems very apt. ”Don’t do the crime if you can’t do the time”. Please don’t bore me with the innocent till proven guilty argument. Some of those held in prison have publicly admitted their crimes.

Lawyers for the defense say their clients had no intention of insulting society or expressing disrespect since the overwhelming majority of Ukrainians consider Stalin and Dzerzhinsky as enemies of Ukraine.

“One of the accused, Ihor Harkhavenko, didn’t even arrive at the tent city in Kyiv until Nov. 25, after the tents were erected,” Levytsky said. “The pretrial investigation has resembled a public relations campaign to show the ‘criminal face’ behind the tax code protests.”

The trouble with Ukraine's 'legal system' is.... there is no rational

legal system as in civilized democratic countries. Whatever unethical

'system' they have is primitive... mostly akin to tribal or clan justice. The 'system' is incomprehensible to rational western minds.
