You're reading: Lutsenko’s lawyers want ECHR to confirm violation of his rights by Ukrainian courts

The lawyers of Ukraine's ex-interior minister Yuriy Lutsenko has described the decision of the Higher Specialized Court of Ukraine for Civil and Criminal Cases on his second appeal as a cynical one.

“The decision of this panel of judges is more cynical in view of its ignoring the demands of the law then the decision of the previous panel of judges on the first verdict,” Lutsenko’s lawyer Oleksiy Bahanets told the journalists on Wednesday, commenting the decision of the court.

He also added: “I am 100% sure that the European Court [of Human Rights] will find confirmation of there being violations of Lutsenko’s right to a fair trial, which the judges of the appeals courts failed to find.”

Lawyer Ihor Fomin, in turn, said the defenders would strive to obtain confirmation at the ECHR of the violations of Lutsenko’s right to a fair hearing in Ukraine on the cases.

“We see (and this is the shared opinion of defense team) that there is no justice in Ukraine. These judges didn’t pass judgment in the hall of the court sitting today, they just announced a decision, which was supposed to uphold earlier taken decisions,” he said.

Fomin said that the ECHR would establish the illegality of such decisions.
