A criminal case opened against Anatoliy Makarenko, the former head of the State Customs Service of Ukraine, has been classified as secret, Ukrainian First Deputy Prosecutor General Viktor Pshonka has said.

"Dear MPs, respecting the will of people’s deputies, I should be guided by the requirements of Article 387 of the Criminal Code regarding the non-disclosure of the data of a pre-trial investigation. Therefore, comprehensive information has been provided in this case. Furthermore, the criminal case contains the documents classified as secret. And the criminal case has been classified as secret," he said, while commenting from the parliament’s rostrum on Tuesday on Makarenko’s arrest.

Pshonka briefed lawmakers on the history of decisions taken by law enforcement agencies regarding the opening of a criminal case against Makarenko and his arrest.

He also noted that the documents on the basis of which the criminal case was opened "do not foresee that RosUkrEnergo, as an owner of natural gas, waived its right to the ownership of gas."

It was reported earlier that in a June 8 ruling, the Stockholm Arbitration Tribunal had ordered Naftogaz Ukrainy to return 11 billion cubic meters of gas to Swiss-registered gas trader RosUkrEnergo (RUE). In addition, the tribunal ordered that RUE would receive from Naftogaz a further 1.1 billion cubic meters of gas in lieu of RUE’s entitlement to penalties for breach of contract.

Security Service of Ukraine (SBU) Chief Valeriy Khoroshkovsky earlier reported on the opening of a case on damages caused to the Ukrainian state in connection with the ruling of the Stockholm Arbitration Tribunal. According to media reports, the former first deputy head of Naftogaz Ukrainy, Ihor Didenko, became the main witness in the case and was ordered not to leave Ukraine. The ex-head of the State Customs Service of Ukraine, Anatoliy Makarenko, was arrested for two months.
