You're reading: Opposition challenges in court CEC’s decision on repeat elections in five constituencies

The opposition has challenged in the Higher Administrative Court of Ukraine the Central Election Commission's (CEC) decision to hold rerun elections in five single-seat constituencies, the head of the council of the Batkivschyna United Opposition, MP Arseniy Yatseniuk, has said. 

“Today we filed a lawsuit against the CEC demanding that the decision to hold the repeat elections be canceled, the votes be counted in the constituencies where our candidates won, and that the victory of opposition candidates be recognized,” he said at a rally outside the building of the CEC on Tuesday.

Yatseniuk said that the Verkhovna Rada, like the CEC, had not taken any decision on the rerun elections and transferred it back to the CEC.

“Neither the CEC nor the Verkhovna Rada adopted a legal decision on the holding of repeat elections. Such a decision does not exist,” Yatseniuk said.

He said that if the CEC does not resolve the situation with the elections in disputed constituencies, the new parliament cannot be recognized as legitimate as a whole.

As reported, the Central Election Commission, in its resolution adopted on November 5, recognized the impossibility of announcing parliament election results in five single-seat constituencies – Nos. 94, 132, 194, 197 and 223. In addition, the commission recognized the need to hold repeat elections in these constituencies and asked the parliament to take a decision on the holding of repeat elections in these constituencies.

At a meeting on November 6, the Verkhovna Rada adopted a resolution proposing to recommend that the CEC schedule repeat elections in five disputed constituencies, Nos. 94, 132, 194, 197, and 223.

According to the resolution, the CEC must determine the amount of spending required to hold the repeat elections. The parliament also recommended that the Cabinet of Ministers take measures to finance the repeat elections.

As reported, parliamentary elections in Ukraine took place on October 28. The CEC has currently received 99.95% of the vote count protocols in electronic form for the vote under party lists, and 99.62% for single-member constituencies.
