The Prosecutor General's Office of Ukraine (PGO) has closed a criminal case against former Head of the National JSC Naftogaz Ukrainy Oleh Dubyna, who was suspected of abuse of power and office while signing a contract on natural gas supplies with Russia in 2009.

The press service of the PGO told an Interfax-Ukraine reporter on Tuesday that the pre-trial investigation into the case against Dubyna (under Part 3 of Article 365 of the criminal Code of Ukraine (abuse of power or office)) has discovered that he fulfilled a direct order from former Ukrainian Prime Minister Yulia Tymoshenko and was deceived by her.

“On January 11, 2012, the investigator with justification closed the criminal case against Dubyna under Part 2 of Article 6 of the Criminal Procedure Code of Ukraine of 1960 due to the absence of evidence of a crime, as stipulated in Part 3 of Article 365 of the Criminal Code of Ukraine,” the press service said.

As reported, the criminal case against Dubyna was opened in April 2011. He was accused of abuse of power and office.

Dubyna was interrogated during the hearing of the gas case against Tymoshenko. The ex-premier said during the hearing that Dubyna had given his evidence under duress.

Kyiv’s Pechersky District Court found Tymoshenko guilty of abuse of office in signing the gas supply contract and sentenced her to seven years in prison on October 11, 2011.
