You're reading: Yanukovych signs law on state land cadastre

Ukrainian President Viktor Yanukovych has signed a law on the state land cadastre which cancels state acts on the ownership right to land plots from 2013, according to the Web site of the head of state.

The Verkhovna Rada adopted this law on July 7.

This law establishes legal, economic and organizational principles of activities related to the state land cadastre.

The land cadastre will contain data on land plots: their cadastral number, location, borders, area, quality of land, use, limitation in land use, monetary value etc.

The holder and administrator of the land cadastre is the central executive agency in charge of land resources.

According to the law, the land cadastre data should be posted on the official Web site of the central body of executive power on land resources, while searching for, viewing, copying and printing data on the boundaries of administrative units, cadastral numbers of land plots, boundaries of land plots, land purpose, land distribution between owners and users, restrictions on land use, general data on the quantitative and qualitative account of land is free of charge.

At the same time, data about the normative monetary evaluation of land, parts of land plots, which are subject to servitude, land sublease agreements, etc., has to be paid for.

Information from the land cadastre is issued by the state cadastre registrars in the form of abstracts about the object, notes containing general information about the land plot, copies from the cadastral map and other cartographic cadastral documents.

Information from the land cadastre can be issued to land plot owners and users (their heirs) or their representatives, state agencies and local authorities, as well as persons licensed to carry out work on land management, appraisal and land auctions.

To obtain information from the land cadastre, it is required to submit an application and a document that confirms payment for the service, which are considered by the cadastral registrar within ten working days.

The law on the state land cadastre comes into force on January 1, 2012 except for certain points.

Earlier, Head of the State Agency for Land Resources Serhiy Tymchenko said that it was planned to launch an automated land cadastre system by the end of this fall.

Tymchenko said that by that time the system would include data on owners and the borders of all land plots.

The database will be expanded with other information on land plots, in particular, their purpose, quality and other parameters.

According to Tymchenko, it will take two or three years to fill up the database.

He said that it will be free of charge to enter the land cadastre system and all information will be open, apart from the personal data of individuals.

The sale and purchase of agricultural land are currently banned in Ukraine. It will last until laws on the state land cadastre and on the land market come into force.

The bill on the land market was passed at first reading only in June 2011.
