The National Bank of Ukraine (NBU) has recommended to the banks that measures be taken to block the departure of dishonest borrowers from the country.

"If banks appeal to the courts to recover credit debts from individual clients, we recommend using the right to make appeals via the submission of relevant applications to the courts," reads an NBU letter.

The letter says that according to Article 151 of the Civil Code of Ukraine, courts, in response to applications from those participating in a case, can issue rulings on the temporary restriction of a person's right to depart from Ukraine.

The NBU also said that legal grounds for temporary restriction of a citizen's right to go aboard are stipulated in Article 6 of the law on departure and arrival to Ukraine. Article 20 of the law on the state customs services allows state customs services officers not to allow persons to pass through the Ukrainian border under written court rulings and documents from law-enforcement bodies.

"The right of Ukrainian citizens to go abroad if they did not meet credit commitments can be temporarily restricted under court rulings or a Prosecutor General's resolution," the letter says.
