BERLIN (AP) — Munich prosecutors say they are appealing the sentence of John Demjanjuk on war crimes charges and the decision to set him free pending appeal.
Prosecutors’ spokeswoman Barbara Stockinger told news agency DAPD Monday that grounds for the appeal would be released only once a written decision is made in the case, which could take months.
Demjanjuk on Thursday was convicted of 28,060 counts of accessory to murder after the court found he served as a Nazi death camp guard, and sentenced to five years in prison. The prosecution had asked for six years, and is allowed to appeal the decision under German law.
The defense has already appealed the conviction. The court ordered the 91-year-old freed pending the end of the appeals process — and prosecutors are also appealing that decision.
