The Constitutional Court of Ukraine has declared constitutional the right of the Cabinet of Ministers to determine the mechanism and amount of social payments, depending on the available financial resources of the Pension Fund's budget.

"Clause 4, Section 4 of the final provisions of the law on the state budget for 2011 is in line with the Constitution of Ukraine," Chairman of the Constitutional Court Anatoliy Holovin said on Tuesday, while reading out a respective court ruling.

Under this clause, the parliament established the mechanism of the payment of social benefits to a number of categories of citizens, authorizing the government to determine the procedure and amount of these payments in accordance with available resources.
