Rada simplifies receiving land property rights

The Verkhovna Rada has simplified receiving land property rights. With 226 votes required, 351 MPs supported endorsement on the whole of law No.4430 amending some legislative acts (on simplifying the order of receiving land property rights).

In particular, the Verkhovna Rada allowed the owner or user of land to independently how land lots (other than farmland) will be used within the requirements set by the law on the use of land with observing the city planning documents and the documents on organization of the use of land.

The parliament has prohibited from denying endorsement of duly agreed project of land allocation. According to the law, the reasons for denying can be only inconsistency of the location of objects with the requirements of the Ukrainian legislation. Permits must be granted within a month after submission of a petition. If such petitions for receiving land property rights are not considered or the bodies of local councils or bodies of local executives refuse to transfer the land to ownership, the question is subject to consideration at courts.

If projects on allocation of land are subject to compulsory examination of documents on organization of the use of land after a decision of a commission on endorsement of the project of allocation or if projects do not require endorsement, such projects are transferred for expertise to bodies of land resources.

The Verkhovna Rada has also regulated the holding of auctions. In particular, a land lot can be sold at a starting price of an auction on the sale of the land lot is recognized failure for presence of only one purchaser. A repeat auction can be held no later than in six months.

Theparliament has added article 186-1 to the existing law. The article contains the rules for the creation and activities of commissions for consideration of issues related to the endorsement of documentation on organization of the use of land.

In March 2009 the Verkhovna Rada allowed certifying the private land property rights in civil agreements.In November 2008, the Cabinet of Ministers urged the Verkhovna Rada to concentrate the powers on registration of land property rights with the central government.
