The legal department of the Football Federation of Ukraine (FFU) has not satisfied Myron Markevych's resignation as head coach of Ukraine's national football team on the basis of Article 39 of the Labor Code.

The press service of the FFU’s legal department reported that firstly, a letter of resignation must be written by Markevych and submitted by him to the FFU’s personnel department, as this document is the basis for the termination of a fixed-term employment contract that was signed in written form.

Secondly, Article 39 of the Labor Code does not foresee "the humiliation of the honor and dignity of a person and a subject of football activities" as the basis for the termination of employment contracts, but, quite the contrary, it contains only four specific grounds, including an illness, disability impeding the fulfillment of work under the contract, the violation by the owner or authorized body of labor legislation, collective agreements or employment contracts, as well as cases foreseen by Article 38 of the Labor Code.

Article 38 of the Labor Code foresees grounds for the termination of employment contracts concluded for an indefinite period at the employee’s initiative: the inability to continue to work (the movement to a new place of residence, the transfer of a husband or wife to work in another area, the admission to educational institutions, the impossibility of living in a certain area confirmed by medical certificates, pregnancy, care for children until they reach the age of 14 or disabled children, care for sick family members in accordance with medical certificates or disabled people, retirement, recruitment by competition, or another reasonable excuse).

The letter of resignation by Markevych has no grounds for the dismissal foreseen by Article 39 or Article 38 of the Labor Code.

Thus, the Football Federation of Ukraine has no opportunity to consider and satisfy Markevych’s request to dismiss him as chief coach of Ukraine’s national football team for the abovementioned reasons.

But, the executive committee of the Football Federation of Ukraine will consider Myron Markevych’s letter of resignation as chief coach of Ukraine’s national football team at an extraordinary meeting at the House of Football on Wednesday, August 25.

The meeting will start at 1100.
