You're reading: High officials discuss harmonization of legislation after cancellation of 2004 constitution reform

In the wake of the cancellation by the Constitutional Court of the Constitution reform of 2004, Ukrainian President Viktor Yanukovych, Prime Minister Mykola Azarov, Verkhovna Rada Chairman Volodymyr Lytvyn, and Justice Minister Oleksandr Lavrynovych discussed the question of the harmonization of the Ukrainian legislation.

Ukrainian News learned this from a statement by the press of the Ukrainian President.

"Our goal is harmonization of the legislation in the near future in compliance with the ruling of the Constitutional Court," said Yanukovych.

In the opinion of the President, this work should be done as soon as possible.

President Viktor Yanukovych noted that the title of the agreement among the factions of the parliament should be reconsidered.

The President also favors further development of the Constitution.

"In particular, one of the vital questions is the reform of the local self-government. We will fail to do this without changes in the Constitution," he said.

Another question requiring settlement is the situation with the election of deputies at all levels.

"It is necessary to harmonize the terms in order not to hold elections each half-year," he said.

Justice Minister Oleksandr Lavrynovych said the ministry has started work to execute the ruling of the Constitutional Court in harmonize all normative acts with the Constitution in the wording of 1996.

Prime Minister Mykola Azarov announced that the government on October 4 will consider a list of questions related to the necessity of harmonization of the normative acts of the Cabinet of Ministers with the decision of the Constitutional Court.

According to Verkhovna Rada Chairman Volodymyr Lytvyn, the parliament will have to introduce amendments to nearly 40 laws in the wake of the decision of the Constitutional Court.

Volodymyr Lytvyn noted that the legislation has no retroaction. Thus, all bodies elected in compliance with the Constitution in the wording of 2004 shall serve the whole terms.

As Ukrainian News earlier reported, the Constitutional Court on October 1 ruled unconstitutional law No.2222-IV entitled "On Amendments to the Constitution of Ukraine," dated 8 December 2004.

The Constitutional Court ordered bodies of state power to immediately align norms of the legislations to conform to the 1996 constitution.

The decision is effective from the moment the Constitutional Court made it.
