The law the law on regulation of town planning, foreseeing the reduction of the term of license obtaining in the construction sphere from 416 days to 60 days and the reduction of the number of permits and procedures of conciliation by four times, from 93 to 23, was published in the Holos Ukrainy newspaper on Saturday.

The Ukrainian parliament adopted the law on regulation of town planning, taking into account the president’s proposals, on Feb. 17 and the president signed the law on March 4, 2011.

The parliament supported the president’s proposals, in particular, in relation to public discussions about town planning. The president said that the law restricts the rights of citizens to take part in discussions about town planning.

The president proposed his wording of the article and the Verkhovna Rada backed it. Thus, the general plans of territories, plans of settlements, plans of territory zoning and detailed plans of territories drawn up in line with the set procedure at local level are to be discussed in public. According to the proposals, draft general plans of territories, plans of settlements, plans on territory zoning and detailed plans of territories are published no later than one month from the moment of their submission to local government bodies.

The president said that capable individuals of the full legal age, who live on the territories under discussion, companies, owners of land plots, representatives of public self-organizing bodies, parliament members and local council lawmakers can submit remarks and proposals to draft town-planning documents.

According to the president’s proposals, a conciliatory commission that consists of officials from the local government bodies, representatives of land resources bodies, representatives of trade unions, architects, scientists and empowered representatives of the public is to be created to discuss issues of contention.

The president said that the procedure for holding a public discussion is determined by the Ukrainian cabinet.

In addition, the parliament supported the president’s proposals, according to which the law would contain a requirement that the issue of the early amendment of general plans can be brought before settlement councils. The lawmakers also supported a presidential proposal according to which a scheme for planning territory in Crimea and its districts is approved by a decision of councils, if a state study of the scheme is also approved.

The law also introduces a declarative principle for preparation and construction of projects with low risks. The principle says that it is enough to submit documents in the established form by construction companies.

The law also introduces the notions of "general town-planning cadastre" and "zoning."

The law amends 104 articles of 26 laws. A total of 26 cabinet resolutions, 17 decrees of the construction ministry and six state construction requirements are to be drawn up.
