You're reading: Court turns down Tymoshenko motion challenging prosecutors (updated)

Pechersky District Court of Kyiv has rejected a motion by former Prime Minister Yulia Tymoshenko's defense team for the recusal of the prosecutors in the Russian gas supply contract case.

Tymoshenko challenged prosecutors Lilia Frolova and Oleksandr Mykytenko, claiming that they had violated the Constitution and other laws.

"They should have stopped the consideration [of the gas case], when they realized that there was no crime," the ex-premier said, speaking in court.

The court ruled that there are no grounds to uphold the motion by Tymoshenko’s defense.

"There is no information about any violations by prosecutors," Judge Rodion Kireyev said.

The prosecutors called Tymoshenko’s claims groundless.

Tymoshenko was taken into custody during the proceedings on August 5, 2011, and has been held at the Lukyanivka detention facility since then.

On the same day, a number of parliamentarians supporting Tymoshenko decided to start an open-ended street protest against her arrest.

The court motivated its decision to put Tymoshenko into custody by "the defendant’s systematic violations; in particular, she obstructed the questioning of witnesses."
