You're reading: Prosecutor: Court to start considering Tymoshenko appeal on Dec 13

Liliya Frolova, a state prosecutor in the Russian gas supply contract case against former Ukrainian Prime Minister Yulia Tymoshenko, has said that the defendant's appeal will undergo preliminarily consideration in a court of appeals in Kyiv on Dec. 1 and that the consideration of the appeal in essence will start on Dec. 13.

"A session on the consideration of the appeal against the criminal case opened against defendant Tymoshenko will be held on Dec. 13, as was decided by the trial court, and on Dec. 1, an appellate court will hold a session on the preliminary consideration of the criminal case, i.e. the preliminary consideration of the case," she told journalists in Kyiv on Tuesday, while commenting on a statement by the head of Tymoshenko’s defense team, Serhiy Vlasenko, that the consideration of the appeal has been postponed.

Frolova said that in this case, "everything has been absolutely correctly assigned by the appellate court."

She said that in accordance with the rules of criminal procedure legislation, the date of the appeal’s consideration is set by the trial court, while an appellate court has the right to conduct a preliminary consideration in accordance with the requirements of the Criminal Procedure Code.

On Oct. 11, Tymoshenko was sentenced to seven years in prison for abuse of office in signing gas contracts with Russia in 2009.

Her appeal against this ruling is to be considered on Dec. 13.

Vlasenko said earlier on Tuesday that a preliminary court session on the consideration of the appeal had been rescheduled for Dec. 1.

He also said that the question of changing the measure of restraint for Tymoshenko and holding a court investigation should be considered on Dec. 1.
