US Congress Backs ‘Practical Framework’ for Ukraine War Crimes Tribunal

House Resolution commends Council of Europe for securing agreement with Zelensky to establish Special Tribunal

WASHINGTON, DC – A bipartisan group of US lawmakers introduced a resolution on Wednesday commending the Council of Europe (CoE) for its efforts to seek justice for the people of Ukraine in response to the “Russian crime of aggression and other international crimes.”

The measure, reviewed by Kyiv Post, was submitted by Representative Marcy Kaptur (D-OH) and co-sponsored by Congressmen Brian Fitzpatrick (R-PA) and Mike Quigley (D-IL), and was referred to the House Committee on Foreign Affairs.

CoE actions hailed as “critical deterrent”

The resolution credits the Council of Europe – an organization dedicated to promoting democracy, human rights, and the rule of law – with playing an “essential role” in addressing the humanitarian crisis and advocating for justice since Russia’s illegal annexation of Crimea and the subsequent military incursions into Ukraine.

The House specifically lauded the CoE for its work to establish accountability. This includes actively documenting and investigating reports of international crimes, such as violations of human rights, war crimes, and acts of aggression, committed during the conflict.

Lawmakers characterized the CoE’s efforts to mobilize international legal mechanisms for the prosecution of war crimes as a “critical deterrent” against future violations of international law.

Crucially, the resolution praised the CoE for establishing a “realistic and practical framework” to create a Special Tribunal on the Aggression against Ukraine.

The measure confirmed that President Volodymyr Zelensky and the Secretary General of the Council of Europe have signed an agreement to establish this Special Tribunal, including the Statute.

Beyond judicial efforts, the resolution also recognized the CoE for providing a platform for its member states to collaborate on various initiatives, including providing humanitarian aid and support for displaced persons.

Lawmakers pledge continued support

The resolution concludes with a three-part mandate: first, formally commending the Council of Europe for its “unwavering commitment” and ongoing efforts to seek justice for the people of Ukraine in response to Russian aggression.

Second, the lawmakers encourage continued collaboration between the US and the Council of Europe to support Ukraine in its pursuit of peace, justice, sovereignty, and democratic governance.

Finally, it reaffirms the House’s commitment to stand with the people of Ukraine and work with international partners to ensure accountability for those responsible for violations of international law.
