You're reading: New national commission to regulate natural monopolies in transport sector

The Cabinet of Ministers is intending to establish the national commission for the regulation of natural monopolies in the transport sector.

This is stipulated in draft law No. 9668 on state regulation of natural monopolies in the transport sector registered at the Verkhovna Rada on January 3, 2012.

According to an explanatory note to the bill, the activities of natural monopolies include the use of rail tracks, dispatcher services, stations and other infrastructure objects that ensure rail traffic, air traffic control, the services of transport terminals, ports and airports.

In addition, according to the draft law, the commission will regulate tariffs for rendered transport services, consumers’ access to these services, and checks on compliance with license conditions.

In addition, the national commission will be authorized to impose fines on natural transport monopolies in the amount of up to 200 untaxable minimum incomes of citizens for late provision of information and 1,000 untaxable minimum incomes of citizens for failure to submit information or its misrepresentation.

The commission’s activities will be financed from the national budget. The amount of funding will be determined at the stage of creating the commission.

As reported, President of Ukraine Viktor Yanukovych created national commissions for state regulation in the sphere of communications and computerization, energy, liquidating the National Commission for Communications Regulation and the National Electricity Regulatory Commission.
