You're reading: Court refuses to change measure of restraint for Ivashchenko

Kyiv's Pechersky District Court has again found no reason to change the measure of restraint from arrest to a travel ban for former Acting Defense Minister Valeriy Ivashchenko, who is accused of illegally signing a bailout plan for Feodosiya Ship and Mechanical Plant.

The presiding judge, Serhiy Vovk, announced a respective decision on Monday, thus rejecting a petition lodged by Ivashchenko’s lawyers.

At the same time, Ivashchenko expressed indignation that representatives of the state prosecution had medical documents on an examination of his health, unlike himself and his defense team.

"Pay attention to the fact that neither I nor my defense team have received the medical records indicating the state of my health, while the prosecutors have received them in full,"Ivashchenko said, while addressing the court.

"Am I a piece of meat with bones, who is not worthy of being granted my own documents? Why does the prosecutor’s office have these documents, which my defense team doesn’t have? I ask the court, which is responsible for ensuring the equality of rights of parties, to pay attention to this," Ivashchenko said.

On Aug. 20, 2010, the Prosecutor General’s Office opened a criminal case against Ivashchenko under Part 2, Article 364 of the Criminal Code of Ukraine (abuse of power or office).

Late in November 2009, Ivashchenko signed a bailout plan concerning the sale of the property of the Defense Ministry’s state-owned enterprise Feodosiya Ship and Mechanical Plant, including strategically important infrastructure facilities.
