You're reading: Yanukovych vetoes law on property transfers in military and emergency situations

Ukrainian President Viktor Yanukovych has returned the law "On the transfer, forced alienation or withdrawal of property in a military emergency or a state of emergency" for the parliament to consider again with his proposals, the president's press service reported on March 19.

The president’s representative in the Verkhovna Rada Yuriy Miroshnychenko will announce the president’s proposals at the plenary sitting.

As reported, on February 23 the Verkhovna Rada voted on the law on the transfer, forced alienation and withdrawal of property in a military emergency or a state of emergency.

According to the law, the forced withdrawal of property in such cases is foreseen by the Constitution of Ukraine and the president’s order on the introduction of a state of military emergency or a state of emergency in Ukraine or in specific regions has to be approved by the Verkhovna Rada.

The law envisages that the forced alienation of property under such condition should be implemented under a decision by military command, agreed with the Crimean Council of Ministers, regional, Kyiv and Sevastopol city state administrations or the executive body of the corresponding local council.

In places where military action is occurring, the forced withdrawal of property can be carried out according to a decision of the military command without the agreement of the mentioned above bodies.

The military command or the body that allowed such withdrawals has to compensate for the forced alienation with state money. The compensation for a forced property withdrawal should be carried out within the next five budget periods in the case of the introduction of military emergency state and within one next budget period in the case of a state of emergency.

According to law, if the legal regime is canceled, than the property should be returned under a court order.
