You're reading: Constitutional Court receives motion from Supreme Court on appointment of HCJ members

On Oct. 13, the Constitutional Court of Ukraine (CC) received a constitutional submission from the Supreme Court on the appointment of members of the High Council of Justice (HCJ).

According to the Communications Department of the Constitutional Court and Legal Monitoring, the motion concerns the compliance of the Constitution of Ukraine with the provisions of Paragraph 13 of Provision 23-1 of Section III “Final and transitional provisions” of the Law of Ukraine “On the High Council of Justice” dated Dec. 21, 2016. No. 1798-VIII, Paragraphs 1, 6, 11 of Provision 4 of Section II “Final and transitional provisions” of the Law of Ukraine “On amendments to certain legislative acts of Ukraine regarding the procedure for the election (appointment) of members of the High Council of Justice and the activities of disciplinary inspectors of the High Council of Justice” dated July 14, 2021 No. 1635-IX.

The text of the constitutional submission can be found on the website of the Court under the heading “Under consideration of the court”.

As reported, the decision to send an appeal to the Constitutional Court was made by the judges of the Supreme Court at the plenum on Oct. 8. Some 129 judges voted for, while 15 judges were against.
