The Solomiansky District Court of Kyiv has canceled the decision by Ukrainian Deputy Prosecutor General and Head of the Specialized Anti-Corruption Prosecutor’s Office (SAPO) Nazar Kholodnytsky of June 1, 2017 to suspend pretrial investigations into the so-called “black ledger” of the Regions Party, criminal proceeding No. 52016000000000166 of May 30, 2016.
According to the single register of judicial decisions, by a ruling of April 3, Judge Maksym Vyshniak partially granted a complaint by Svitlana Baidan, lawyer for Chairman of the Central Election Commission of Ukraine Mykhailo Okhendovsky.
This decision is not subject to appeal, and the court was to announce its full text on April 10.
The SAPO told Interfax-Ukraine that it expects the full text of the court’s decision and then the investigation will be resumed.
At the same time, the SAPO drew attention to the fact that further actions by the prosecutor’s office “will depend on the content of the full text of the ruling, in particular, what motivated the judge to cancel the decision on suspension.”
“Currently, these motives remain completely unknown to us,” the SAPO added.
As reported, NABU detectives and SAPO prosecutors started a pretrial investigation into the so-called “black ledger” of the Regions Party on the basis of documents handed over by Viktor Trepak, a former first deputy head of the Security Service of Ukraine, on May 30, 2016.
As part of the investigation, on December 13, 2016, Head of the Central Election Commission Mykhailo Okhendovsky, whose surname and signature appeared in the documents sent, was notified of a suspicion in obtaining unlawful gain of $161,698, which was equivalent at the NBU exchange rate at the time of the commission of the crime to UAH 1.294 million (Part 3 and Part 4, Article 368 of the Criminal Code of Ukraine).
