The Grand Chamber of the Supreme Court partially upheld the appeal of candidate for MP in constituency No. 87 Oleksandr Shevchenko against the Supreme Court’s decision of April 28, 2020 on recognizing the decision of the Central Election Commission (CEC) to establish the results of the by-elections as legitimate, the OPORA Civil Network has reported on May 2 night.

“The Grand Chamber of the Supreme Court adopted a resolution by which it recognized the actions of the Central Election Commission to establish the election results in constituency No. 87 as illegal and declared illegal and canceled the CEC protocol of April 22, 2021, which established the election results and declared Vasyl Virastyuk the winner in constituency No. 87. Thus, the Grand Chamber partially upheld the appeal of Oleksandr Shevchenko against the Supreme Court’s decision of April 28, 2020 in case No. 9901/114/21,” the statement on the OPORA Civil Network website said.

In this case, Shevchenko disagreed with the CEC protocol of April 22, 2021 on the election results in 87th constituency and appealed against the said protocol and the CEC’s actions to establish the election results in the Supreme Court. In addition, in the lawsuit, he asked to oblige the CEC to continue to establish the election results and send the district election commission of 87th constituency to clarify the protocol.

As reported, representative of the Servant of the People party Vasyl Virastyuk won the parliamentary by-election in constituency No. 87 with 31.25% of the votes. His rivals, representative of the For the Future party Oleksandr Shevchenko, and representative of the All-Ukrainian Association Svoboda, Ruslan Koshulynsky gained 29.69% and, accordingly, 28.86%. At a meeting on April 5, the Central Election Commission of Ukraine recognized the elections in the constituency as valid.
