You're reading: Supreme Court satisfies NBU’s appeal on error regarding Bukovel resort

The Supreme Court upheld the appeal on error of the National Bank of Ukraine (NBU) against rulings of the courts of lower and appellate instances, which terminated mortgage agreements between the NBU and Skorzonera LLC, under which the company acted as a property guarantor of the debts of PrivatBank (Kyiv) to the NBU for refinancing loans, the press service of the central bank has told Interfax-Ukraine.

“Today, the Supreme Court reviewed the appeal on the error of the National Bank of Ukraine against rulings of courts of lower and appellate instances, which terminated mortgage agreements between the NBU and Skorzonera LLC (Bukovel). Based on the results of the review, the Supreme Court overruled the rulings dismissing claims of Skorzonera LLC,” the press service of the NBU said in response to a request from Interfax-Ukraine.

According to the report, the NBU considers such a decision of the Supreme Court to be one of the examples of ensuring the rule of law in modern conditions of reforming justice in Ukraine and expects that in future the courts will take into account the legal position of the Supreme Court in similar disputes.

According to the public register of ownership rights to immovable property, the mortgaged property is the property where the Bukovel ski resort is located.

According to the public register of companies, the ultimate beneficiaries of Skorzonera LLC are Ihor Kolomoisky and Hennadiy Boholiubov.

The Bukovel ski resort was transferred to the balance sheet of PrivatBank during its nationalization.
