The Grand Chamber of the Supreme Court will consider the case against the decree of the President of Ukraine Volodymyr Zelensky, which canceled the appointment of Oleksandr Tupytsky as a judge of the Constitutional Court of Ukraine.

“The Grand Chamber of the Supreme Court, by its decision of October 7, appointed for consideration the appeal of the President of Ukraine against the decision of the Administrative Court of Cassation within the Supreme Court in case No. 9901/96/21 on the claim of Oleksandr Tupytsky against the decree of the President of Ukraine of March 27, 2021. No. 124/2021 on some issues of ensuring the national security of Ukraine in terms of canceling decree of the President of Ukraine dated May 14, 2013 No. 256 on the appointment of the plaintiff as a judge of the Constitutional Court of Ukraine,” the press service of the Supreme Court said on Facebook.

A court session to consider the appeal is scheduled for 11:00 on November 17.

In July, it was reported that the Supreme Court overturned the decree of Ukrainian President Volodymyr Zelensky on the abolition of the decree on the appointment of Oleksandr Tupytsky as a judge of the Constitutional Court of Ukraine, a source in the Supreme Court told Interfax-Ukraine.

The President’s Office said that Zelensky intended to appeal the decision of the Supreme Court on declaring unlawful his decree of March 27 on some issues of ensuring the national security of Ukraine, which canceled the decree of former President Viktor Yanukovych on the appointment of Oleksandr Tupytsky as a judge of the Constitutional Court of Ukraine.

Tupytsky lost his status as a judge of the Constitutional Court of Ukraine due to the cancellation by President of Ukraine Zelensky of Viktor Yanukovych’s decree on his appointment, since, in accordance with the decision of the National Security and Defense Council (NSDC), his continued tenure as a judge of the Constitutional Court would constitute a significant threat to the national security of Ukraine. By the same decree, Zelensky canceled the decree on the appointment of Oleksandr Kasminin as a judge of the Constitutional Court.
